A period of waiting at AIMA does not, by itself, identify the legal remedy. Before making a demand or going to court, the applicant should establish what was requested, how and when it was filed, whether the authority sought further documents, and what effect the delay has on the person’s situation. The answer may differ for an initial residence application, a renewal, a family matter and a refusal.
Reconstruct the administrative history
Keep the application receipt, registration or case number, payment records where applicable, copies of submitted documents, requests for additional evidence, correspondence, appointments and decisions. AIMA currently provides specific channels for certain missing documents through its contact form; the correct channel depends on the procedure. An applicant should not assume that a generic message replaces a formal application or a response required in a particular case.
What if documents are missing or a decision is adverse?
A request for documents needs a timely and relevant response supported by proof of submission. A refusal or cancellation calls for review of the notification, its reasoning, the applicable route and any stated deadline. Whether an administrative challenge, a new filing or judicial proceedings is appropriate depends on the decision and the legal position. The first consultation should therefore focus on the actual file rather than a generic estimate of waiting time.
Administrative action and interim relief
Article 87-B of the Foreigners Law, introduced by Law 61/2025, states that judicial actions concerning AIMA decisions or omissions in the relevant chapter take the form of an administrative action under Article 37 of the Code of Procedure in Administrative Courts. Interim protection under the general rules remains possible. The claim, evidence and any need for an interim measure require separate analysis; delay alone does not establish that a particular application will succeed.
When can the urgent intimação be considered?
The same Article 87-B sets additional conditions for the intimação para proteção de direitos, liberdades e garantias. Beyond Article 109 of the procedural code, the AIMA act or omission must seriously and directly compromise the timely exercise of personal rights, freedoms or guarantees, and available interim measures must be unable to protect them effectively. The court also considers the factors specified in the statute when asked. This is a case-specific remedy, not an automatic fast track for every pending residence file.
How a lawyer can assist
Counsel can reconstruct the procedural chronology, identify evidence and deadlines, assess communications and decisions, prepare an administrative response, and determine whether judicial action is supported by the facts and applicable law. A professional assessment should distinguish an urgent legal need from ordinary uncertainty and explain the scope of the proposed work without promising an outcome.
