What a Brazilian spouse or partner changes
Under the ordinary naturalization rules, the usual residence period is four years. A person married to or in a stable union with a Brazilian citizen may qualify for a reduction to one year, provided the relationship continues and the couple is not legally or factually separated when naturalization is granted. The reduction concerns the residence period; the other requirements still apply.
Residence comes first
The Ministry of Justice explains that the relevant period generally runs from the date of residence for an indefinite period registered with the Federal Police. A family-based visa or residence authorization is a distinct immigration procedure. A marriage certificate alone is neither proof of the required residence period nor a grant of nationality.
Requirements and evidence
The application calls for civil capacity, the required period of residence, ability to communicate in Portuguese under the applicable rules, and absence of a disqualifying criminal conviction or proof of rehabilitation. Evidence may include the migration registration, residence records, an updated marriage certificate or evidence of stable union, a joint statement about continuing cohabitation, criminal records and other documents required for the individual case. Foreign records may require legalization or apostille and translation.
When legal assistance is useful
A lawyer can review whether your residence history meets the correct threshold, assess how a foreign marriage or stable union is documented in Brazil, address inconsistencies across civil and migration records, prepare the evidentiary file and respond to administrative requests or adverse decisions. Scope and fees are agreed after the facts and documents are reviewed.
