The route and its limits
Resolution CNIG No. 45/2021 provides for a temporary visa or residence authorization for remote professional activity connected to a foreign employer, without employment for a Brazilian employer. It also addresses activity during a visit, subject to the visitor’s permitted stay and visa rules. A visitor stay and residence authorization are different statuses; the appropriate route requires analysis of the intended duration and specific facts.
Evidence to prepare
The official framework calls for proof of the foreign professional relationship, such as an employment or services contract or other suitable documents. It specifies foreign-source income of at least US$1,500 monthly or available bank funds of at least US$18,000. The form, consistency and current validity of records matter, particularly with multiple clients or variable income.
Application and family context
Depending on your location and circumstances, the procedure may involve a Brazilian consular post or an in-country residence application. Registration, family residence and later changes of status are separate steps whose documents and deadlines should be checked against the competent authority’s current instructions.
Professional assistance
Counsel can assess eligibility, identify the proper filing route, review contracts and financial evidence, organize the submission, respond to requests for additional documents and advise on related family or cross-border legal matters. No application can be guaranteed approval.
